Kent Westberry is a Partner in Landrum & Shouse LLP, a 32 lawyer firm with offices in Louisville and Lexington. Kent has maintained a statewide and regional practice in complex criminal defense for clients appearing in federal and state court. Over a number of years, Kent has defended some of the largest and most highly publicized criminal prosecutions in the Commonwealth of Kentucky. However, despite the nature of the cases handled by Kent and Landrum & Shouse, it is our belief that the most successful White Collar defenses should not be high profile. Attorneys are most effective at the investigative stage, before an indictment has been returned and in the headlines.

Kent has been listed in the White Collar Crime sections for publications such as Best Lawyers in America and Kentucky Super Lawyers Business Edition. He has, for many years, maintained an AV® Preeminent™ rating from Martindale-Hubbell.

Over a number of years, Kent has defended some of the most significant criminal prosecutions in the Commonwealth of Kentucky. In 2005 and thereafter, Kent served as lead counsel for former Kentucky Governor Ernie Fletcher in the Merit System investigation which resulted in a dismissal of all charges brought against this former Governor. Kent has recently served as counsel to a former Governor from the Northeast with regard to a Federal Grand Jury Investigation involving a now defunct business college in Kentucky. This investigation was closed without criminal charges being brought. Over the past several years, Kent has represented clients in criminal investigations and trials on behalf of the coal industry. In particular, Kent is currently involved in the Crandall Canyon Mine disaster where an investigation is being conducted by the Mining Safety and Health Administration ("MSHA") and the United States Attorney's Office in Utah. In the past, Kent was involved in representing executives in the Pyro Mine disaster where no charges were brought against his client. More recently, Kent obtained an acquittal for a coal mining executive in United States v. B&D Mining in federal court in Abington, Virginia. Kent has also obtained a significant judgment of acquittal for felony counts, post verdict, in United States v. KenAmerican Resources, et al. for his client who was a mine superintendent. The court ultimately sentenced this client as well as others to probation after a month long jury trial.

Kent and his firm have handled virtually all types of White Collar matters. Kent has represented clients involving securities and insurance fraud. Other matters involve state and federal tax violations, mail and wire fraud, false statements, RICO government contract fraud, environmental fraud and money laundering. Kent has represented state court judges, attorneys, physicians, and other professionals in criminal investigations. Kent frequently advises businesses, municipalities and individuals in responding to requests for documents and records from grand jury subpoenas. Early in his career, Kent obtained an acquittal for an accountant in a criminal tax prosecution, United States v. Schultz. Other recent examples of successful representation involve convincing the United States Attorney's Office not to seek an indictment involving a former healthcare executive in a highly publicized investigation in Louisville. Kent is currently representing businesses regarding alleged tobacco excise tax violations in investigations throughout the Southeastern United States.

More recently, Kent has been involved in defending elected and appointed officials in voter fraud cases brought in federal court. These prosecutions have involved substantial post trial briefing as a result of the recent Supreme Court decision in Skilling as well as alleged Brady/Giglio violations resulting from the government's failure to produce exculpatory and/or impeachment material in advance of trial.

Kent served as President of the Kentucky Bar Association from 2004-2005. Kent also served with distinction as an Assistant United States Attorney for the Western District of Kentucky from 1981-1987. Kent has served as a Special Justice of the Kentucky Supreme Court and as Chairman of the Civil Justice Reform Act for the United States District Court for the Western District of Kentucky. He is a currently a member of the Board of Directors of the Federal Public Defenders Corporation. Kent is a Life Member of the U.S. Sixth Circuit Judicial Conference and a member of the American Board of Trial Advocates. Kent has served in 2011 as Chairman of the United States District Court Magistrate Judge Merit Selection Panel, United States District Court, Western District of Kentucky – Louisville Division.  He currently serves as Chairman of the Kentucky Bar Association Mentoring Committee.
