Working through the details of a workers’ compensation claim

On Behalf of | Oct 26, 2022 | Workers’ Compensation

Injuries that occur on the job are, unfortunately, quite common in Kentucky and throughout the country. And, injuries aren’t just limited to potentially dangerous jobs, like construction work. The fact is that all types of injuries can occur in any workplace. Fortunately for injured workers in Kentucky, they can submit a claim for workers’ compensation.

However, working through the details of a workers’ compensation claim requires patience and persistence. These incidents must be handled properly in order for the claim to go as smoothly as possible. First, the incident needs to be reported to the employer as soon as possible. Medical treatment is usually an immediate concern—as is who will pay for that treatment.

Next, will the injured worker be approved to receive a percentage of wages while absent from work and recovering from the injury and, if so, how much? For the most part, any type of workplace injury is supposed to be covered by workers’ compensation, no matter the cause. However, if the employer suspects deliberate action or questions that the injury actually occurred in the workplace, there may be a challenge to the claim.

Charting a path

At our law firm, we work with injured employees to chart a path forward after a workplace accident occurs. The process of applying for workers’ compensation benefits can be mystifying to someone who has never been through the appropriate steps. In addition to concerns about medical care and their injuries, workers who go through this process have many questions about the legal process. Getting the right information is crucial to being successful in a workers’ compensation claim.
