Autumn Hines, a proud graduate from the University of Kentucky double-majored in Integrated Strategic Communication (ISC) and Political Science. Outside of school, she worked as a legal runner at Landrum & Shouse LLP where she met Pierce Hamblin. For her ISC class on specialized PR writing, Autumn was assigned to write a profile about someone who represented one of UK’s PR objectives (e.g., diversity, community outreach, commitment to students). She chose to write about Mr. Hamblin’s experience as an adjunct professor at the University of Kentucky College of Law. During her time at Landrum & Shouse, Autumn saw the way Mr. Hamblin committed himself to helping others- from other attorneys to the summer law clerks and to his “kids” at UK College of Law.
Pierce Hamblin: A different kind of attorney……..
Attorneys aren’t always known for their warmth or sense of humor, but Pierce Hamblin is quick with a joke and knows how to make anyone feel at home.
Pierce is a seasoned lawyer and teacher. For 41 years, he has litigated and mediated cases at Landrum & Shouse. But perhaps more importantly, for 40 years, he has taught as an adjunct professor at the University of Kentucky College of Law where he teaches courses on litigation skills and negotiations to senior law students. Over the years, he has demonstrated a steadfast commitment to student success and will continue to do so for years to come.
“One of my greatest passions in life has been teaching at the UK College of Law. I think it’s important to teach my students to be good lawyers, but it’s more important to teach them to be good people,” Pierce said.
Shortly after he began teaching, Pierce realized that it was one of his duties to help his students in any way he could. He explained that someone helped him once, and it’s important that his students realize that one day, they will have the duty to help young lawyers as well.
As a young man, Pierce was drawn to law because of his father who inspired him to join the Army and attend the University of Kentucky. He graduated from the University of Kentucky College of Law in 1977 and followed that with the U.S. Army JAG School at the University of Virginia College of Law in 1986.
After he became a lawyer, Pierce quickly began learning what it took to be successful in the legal field, and this knowledge is what he strives to share with his students. As a new attorney, he would go to motion hour at the circuit clerk’s office to meet as many clerks, judges and lawyers as possible. It didn’t matter if he had a case with them or not- he would still go up to them, shake their hand and introduce himself.
“I would tell them I’m Pierce Hamblin. I don’t have anything to ask you- I just wanted to meet you and tell you I’m a new lawyer and I’m from Lexington,” Pierce said.
It’s safe to say that this approach has paid off over the years. Pierce is well-respected among his peers and by his students and he never meets a stranger. He is friendly and approachable and he genuinely cares what you have to say.
“One of the first things I tell my students is that nobody cares a damn bit what you have to say until they know you care about them,” Pierce explained.
In addition to a wealth of legal knowledge, on the first day of class, Pierce gives his students a copy of a Teddy Roosevelt quote to help them learn to not let their actions be influenced by their fears.
“The last part of the quote is great. [Teddy Roosevelt] said, ‘…his place shall never be with those timid souls who neither know victory nor defeat.’ Can you imagine being that miserable? Huddled over in the corner and wanting to do something but you’re afraid you might fail at it,” Pierce said.
“And the last thing I tell them is that the greatest test of courage is to bear defeat without losing heart,” Pierce concluded.
Along with these words of wisdom, Pierce gives his students the tangible tools they need to be successful in their law careers. His litigation skills class is always in high demand among third-year law students.
Throughout the semester, students learn how to do discovery, how to use the rules of evidence, how to introduce exhibits at trial, how to do the opening and closing statements, how to try a case and the skills and confidence necessary to perform as young lawyers.
“While I was clerking at Landrum and Shouse, Pierce took me under his wing and allowed me to help him with some of his nursing home arbitration practice. Without Pierce, I would have never ended up where I am now, and I will be forever grateful to him for that,” said Hannah Jamison, an attorney at Cicero Law Firm.
The way Pierce Hamblin has touched and impacted the lives of others over the years is immeasurable. It’s rare to find someone genuinely willing to help others. Pierce has committed his life to serving others- from his time in the military to his career as an attorney and his years as a teacher and mentor.
“Pierce Hamblin is the epitome of a dedicated legal professional, in particular regarding his mentoring of young lawyers and students. His skill as a lawyer is clear, but it is his commitment to the success of our students and other young lawyers that makes him stand out to me as a true professional,” said Mary Davis, the Dean of the University of Kentucky College of Law.
At 71, Pierce shows no signs of slowing down. He is still actively involved in the community and he is always looking for ways to support his “kids.” Pierce Hamblin’s commitment to students is unmatched and he is truly an asset to the University of Kentucky College of Law. #lawyer#legal #attorney #mediator #arbitration

In memory of my dear friend Don McNay –
“The only appropriate birthday gift for my dear friend, Pierce Hamblin is this copy of Ric Flair’s autobiography – To Be The Man. Pierce is the guy you always want in your foxhole. He has literally checked in with me every day since my weight loss surgery and is a true and loyal friend. He also has an incredible work ethic. I think I have been in his office for most of his birthdays over the past 25 years.” #inlovingmemory #neverforgotten #friendsforlife

Our L&S team members and local first responders wanted to honor and remember the 9/11 victims with a memorial stair climb.
Over 300 first responders gathered at Kroger Field to respond as a community and honor the first responders from 9/11. Members from the Lexington Fire Department, Air Force ROTC, UK Army ROTC and Lexington Police Department climbed the equivalent of 110 flights of stairs in memoriam of the 403 firefighters and police officers who died on 9/11.
Each climber could choose to wear badge with the name and image of a 9/11 first responder or a fallen Lexington officer. As they climbed, they would complete their lap, ring a bell and say the person’s name they climbed for.
We want to honor and always remember the victims from this day. Our team members representing L&S were Gavin Henshaw and Dominic Donovan, special thanks to both of them for supporting such a worthy cause. #911 #911memorial #neverforget #911neverforget #Honor911 #PatriotDay

The National Bar Association’s John Rowe Chapter hosted their first annual Law Camp from July 15th to July 19th. The camp currently focuses on African-American high school boys between 9th and 12th grades. During the week, campers learned basic legal skills and courtroom decorum which concluded with a mock trial. Each side presented an opening statement, direct examination, cross examination and a closing. The jury found the Defendant not guilty. All participants exceeded expectations, and have developed an interest for litigation. Out of the experiences from the week, the students and organization leaders are discussing the possibility of forming a mock trial team.
Judge Pamela Goodwine of the Kentucky Court of Appeals presided over the trial, while Neely Williams, associate attorney with Stoll Keenon Ogden PPLC, served as co-counsel and mentor to the students, and Landrum Shouse law clerks Alex Henning, Chynna Hibbitts and Clay Thornton served as members of the jury.
A special thank you to Beth Winchell, partner at Landrum Shouse, and the firm for their continued commitment to develop prospective young lawyers in the Lexington community and throughout the Commonwealth.

2018

Special CONGRATULATIONS to all of our LS Best Lawyers in America and our Lawyer of the Year – John McNeill for 2019!
Attorneys named to The Best Lawyers in America were recognized by their peers in the legal industry for their professional excellence in 145 practice areas. For the 2019 Edition of The Best Lawyers in America, 7.8 million votes were analyzed, which resulted in more than 60,000 leading lawyers being included in the new edition.
“Best Lawyers was founded in 1981 with the purpose of highlighting the extraordinary accomplishments of those in the legal profession. After three decades, we are proud to continue to serve as the most reliable, unbiased source of legal referrals worldwide,” said Best Lawyers CEO Phil Greer.
The process begins when attorneys are nominated for consideration. They are divided by geographic region and practice areas, and are evaluated by their peers on the basis of professional expertise. Those who receive high peer reviews undergo an authentication process to make sure they are currently practicing and in good standing. Only then can these top attorneys be recognized by Best Lawyers.

Congratulations to Partners, Daniel E. Murner and Elizabeth J. Winchell on a successful defense trial verdict!
The lawsuit arose from an accident at the intersection of Broadway and 10th in Louisville, KY involving a tractor-trailer and passenger vehicle. Plaintiff alleged that the tractor-trailer ran a red light, causing the impact. Plaintiff argued that the tractor-trailer was driving too fast for conditions because the driver was in a hurry, and that he ran the red light as a result. Defendants argued that the Plaintiff’s recollection of how the accident happened was so flawed that his memory of the color of his stoplight was also inaccurate.
The jury deliberated for one hour before returning a defense verdict on liability.

The case arose from an accident at an intersection, with allegations that the truck driver was speeding and failed to keep a proper lookout to avoid the accident. The defense responded that the Plaintiff ran a red light and “darted” into the intersection, leaving the truck driver with no time to react to avoid the accident.
The Plaintiff suffered a head injury and remains in a vegetative state. Plaintiff sought over $1 million in past medical expenses, over $5 million in future medical expenses, and $7.8 million in past and future pain and suffering.

Lacey Fiorella and Dan Murner tried a trip and fall case in Jessamine Circuit Court the week following Thanksgiving. Our client, ARC Development, LLC was the owner of the property where Plaintiff, age 70 at the time, fell after stepping in a depression in the pavement. Plaintiff’s counsel called the depression a hole. The depression was located at the top of a parking space and was designed to allow access to a sewer cleanout. Plaintiff fell as she was returning to her car to retrieve her phone. Plaintiff’s expert testified that the condition was a “severe defect” in the property. Defendant argued Plaintiff’s failure to watch her step while wearing wedge sandals.
Plaintiff suffered a fractured patella and fractured 5th metatarsal. She also claimed headaches and neck pain. The medical expenses totaled approximately $25,000. Plaintiff sought $300,000 in pain and suffering at trial.
Plaintiff turned down a sum at mediation and opted for trial. The jury deliberated for 15 minutes and returned with a defense verdict.

And The Defense Wins
Landrum Shouse LLP partner Michael E. Hammond and associate Lacey Fiorella successfully defended Copart of Connecticut and two employees in a wrongful death action that resulted from a fatal motorcycle accident in Louisville, Kentucky. The case was Lauren Savage, et al. v. Copart of Connecticut, et al., 12-CI-06824, in Jefferson County (KY) Circuit Court.
The trial spanned two weeks and included testimony from 20 witnesses. The plaintiffs, the estate and widow of the decedent, contended that Copart negligently permitted salvage vehicles that had been sold via auction and transferred to an owner, to be transported unsafely and contrary to Kentucky law. Plaintiff’s counsel contended that Copart should have determined the manner in which the salvage vehicles were to be transported prior to release. The defense focused on the evidence indicating that the accident was actually caused by pallets that were dropped into the road (as opposed to the condition of the auctioned vehicles and their manner of transport) and evidence to suggest that the manner of transport was established hours after pickup from the Copart location and at a different location.
During the trial, the court granted the defense’s motions for directed verdict with respect to punitive damages and on a negligent entrustment claim. After four years of litigation, on June 2, 2016, the jury rendered a unanimous defense verdict in favor of Copart and its two employees.
Mr. Hammond is a member of the DRI Construction Law and Trucking Law Committees. Ms. Fiorella joined DRI in June 2016.

UK Army ROTC Inducts Three Community Leaders Into Wall of Fame
Three University of Kentucky Army ROTC alumni and community leaders were honored last week with induction into the UK Army ROTC Wall of Fame. Inductees included Lt. Col. (retired) Keith Jackson, Lexington Division of Fire and Emergency Services chief; attorney Pierce Hamblin; and Maj. (retired) Marty Pinkston.
At the UK Army ROTC annual Mentorship Breakfast Thursday, Feb. 26, cadets, UK Army ROTC leadership and guests gathered to praise the men for their contributions in the United States Army and to the UK community. Inductees also shared their experiences as soldiers and UK Army ROTC cadets, and offered words of wisdom to current cadets.
“They served during their military career with confidence, commitment and character, leaving lasting legacies and positive impacts on those they led. And they continue to do so by leading in our communities, supporting soldiers and veterans, and mentoring our cadets,” said Lt. Col. and Professor of Military Science Shawn Umbrell. “They have given and continued to give in ways that honor our profession and create a better environment for those around them. So we honor them this morning by inducting them into our Wall of Fame.”
Jackson, the first African American to serve as fire chief in Lexington, graduated from UK with a bachelor’s degree in communications in 1987. A cadet in Army ROTC at UK, he also commissioned as a second lieutenant in the U.S. Army. After serving 27 years in the reserves and a 12-month deployment in Iraq, Jackson joined the Lexington Division of Fire in 1991, working his way up from paramedic, captain, and major to interim chief. In 2012, he was named permanent chief.
Jackson credited the U.S. Army and UK Army ROTC with helping him find direction during his sophomore year of college.
“I chose to become a member of the United States Army and it actually helped save me, saved my life as far as a direction…it gave me my mantra. My mantra has always been ‘opportunity is the great equalizer,’ and that means that given the opportunity to do good things, you can do good things,” Jackson said at the ceremony.
Pinkston, former deputy commissioner of the Kentucky Department of Veterans Affairs (KDVA), graduated from UK in 1979 with a degree in history and commissioned as a second lieutenant. After four years of active duty in Texas, Pinkston returned to the Bluegrass to serve more than 20 years in the Kentucky Army National Guard. After a post in the Kentucky Community and Technical College System and several in KDVA, eventually being appointed deputy commissioner, Pinkston retired in 2008.
Sharing a story about one of his mentors, Pinkston advised UK Army ROTC cadets, saying, “If that mentor doesn’t walk up and grab you by the stacking swivel and say, ‘I’m your mentor,’ go find one.”
Hamblin, a litigator at Landrum and Shouse and adjunct professor at the UK College of Law, received his degree in business administration from UK and commissioned as a second lieutenant through UK Army ROTC in 1973. In 1977, he received his juris doctor from the UK College of Law, and in 1986 graduated from the U.S. Army’s Judge Advocate General’s Legal Center and School (JAG School) at the University of Virginia. A distinguished graduate of the U.S. Army Military Intelligence Officer Course for 1977-1978, Hamblin ended his service as JAG Officer for an Army Training Brigade.
“How do you learn leadership? How do you learn to care for others and let them know it? How do you go through life without letting your actions be influenced by your fears?” Hamblin asked cadets. “You do exactly what you’re doing. You take your military training, your military profession, and that teaches you all three things.”

U.S. Dept. of Labor to Revitalize Overtime Protection for Employees
Written by: Erin C.S. Izzo
The Fair Labor Standards Act (FLSA) guarantees eligible employees a minimum wage and overtime pay for hours worked in excess of 40 in a work week. However, there are a number of exemptions to that guarantee. The “white collar” exemption contained in 29 C.F.R. 541 is based in part on a minimum salary level, with those exceeding it potentially being exempted from FLSA overtime protection. More than a decade has passed without any change in the minimum salary level, while at the same time the federal minimum wage has increased. This has resulted in certain low-paid salaried employees finding themselves without overtime protection. In March 2014, President Obama directed the U.S. Department of Labor to update FLSA regulations, and in particular the “white collar” exemption, in order to modernize and simplify the regulations while maintaining the FLSA’s intended overtime protections.

Super Lawyers Ohio Kentucky 2015
Pierce W. Hamblin greets visitors warmly. “Come in! I have a gift for you,” he says with a grin. He smiles while you wait for it. Then he pulls out a bag of MMs.
He likes to make a good first impression. He likes to make a good last impression, too, as well as a good everything-in-between impression.
This is not hard for the 6-foot-7 litigator, mediator and teacher, muscular-hulky at age 63 like a Kentucky oak. He has achieved an impressive distinction in each of the fields he has entered. But when you meet him, what most comes across is a will to connect.
Hamblin is a partner at Landrum Shouse, which employed him 37 years ago, fresh from law school. He was born in Lexington and has remained there ever since. When he was growing up, Lexington had about 25,000 people, and it seemed like everyone knew everyone else. With a population of more than 300,000, it doesn’t feel like it’s changed that much. “It still has that small-town culture to it,” he says. “It’s friendly, and you can go five miles any way from my building and you will be in horse-farm country. So at the end of the day, after fighting in court or doing tough mediations, one can take a five-mile jaunt and be in a peaceful place. I find that comforting.”
The defense lawyer has made a reputation primarily for his work on insurance cases. When someone is in an accident and is sued, his or her insurance company hires Hamblin to represent its client. He has worked many products liability, automobile accident, and medical and legal malpractice cases.

2014 | CONGRATULATIONS Larry C. Deener on receiving the 2013 Chase College of Law Outstanding Alumnus Award. Read his story below…..![]() “Dedication” describes the life of Chase College of Law graduate, Larry Deener. Dedication to family. Dedication to country. Dedication to work and community. Dedication to family begins with his wife of 42 years, Martha. “Her support and guidance over the past 42 years has been the most important factor in my career;” he says. Dedication is also present in his relationship to his daughter, Elizabeth, who also works at the offices of Landrum and Shouse LLP, in Lexington, Ky., where the father and daughter are law partners. Deener’s theme of dedication can be seen in his service as an active duty Captain in the United States Air Force, prior to attending law school. After active duty, Deener attended NKU Chase College of Law, where he was the editor in chief of the Northern Kentucky Law Review and earned recognition as Distinguished Graduate. Deener was a member of the Order of the Curia and co-author of “Legal Ethics in Kentucky:” Upon graduation, Deener served as a law clerk to the late Justice Robert O. Lukowsky, Kentucky Supreme Court, before joining Landrum Shouse LLP in Lexington, Ky., where he has practiced law since 1980. He is a member of the Kentucky Bar Association Ethics Committee and serves on the Board of the Fayette County Bar Association Foundation. |

In his home community, Deener has served as an Elder, Deacon, Trustee of the Second Presbyterian Church and on the Board of the Aviation Museum of Kentucky. In 2012 his service to others and the community were recognized when he was presented a National Philanthropy Day Award.
