How the plaintiff’s social media posts can help your defense

Alleged truck accident victims often turn to social media for support. In doing so, they often post information and photographs that depict a life that’s much better than they’ve claimed in their personal injury case.

For example, although a plaintiff might claim that they’ve suffered debilitating injuries in their legal filings, their social media posts might show them playing outside with their children or engaging in other physical activity. Or, the plaintiff’s social media posts may give indications that they feel guilty for having caused the accident in question.

There’s a good chance that you won’t be able to publicly view the plaintiff’s social media page, but that shouldn’t deter you from finding other avenues to view their posts.

For example, you might be able to publicly access their friends’ social media pages, which could have pictures of the plaintiff engaging in questionable behavior. If you can, capture screenshots of these posts so that you can use them during settlement negotiations and trial.
